Draft pending legal review. This text states what the agreement must cover and is not yet vetted language. It is published rather than withheld because a service with no terms at all leaves both sides worse off — and saying so here is more honest than presenting unreviewed wording as final.
The short version, which the clauses below say in full: this product exists to help you investigate. It does not promise to catch every incident, it does not replace your monitoring or your response process, and what it concludes is assistive rather than authoritative.
These terms govern the use of InsightRecorder, operated by Solution4Mac. Using the service means accepting them. If you are accepting on behalf of a company, you confirm you are authorised to bind it.
Where a signed agreement exists between you and Solution4Mac, that agreement takes precedence over these terms wherever the two differ.
InsightRecorder is a tool for investigating incidents. It collects sessions, logs, metrics and traces, correlates them, and produces reports and alerts to help an engineering team understand what happened.
It is a support tool for investigation. It is not a monitoring system, not an incident response process, and not a substitute for either. It is not safety-critical equipment, not a medical device, and not industrial control software, and it must not be used as any of those.
The analysis it produces — including anything generated by a language model — is probabilistic and assistive. It is never authoritative. Decisions about your systems remain yours.
The service is provided "as is" and "as available", without warranty of any kind, whether express or implied — including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
We do not warrant that the service will detect any particular incident, that it will detect every incident, that an alert will fire, or that an alert that fires is correct.
To the fullest extent permitted by law, Solution4Mac is not liable for any loss or damage arising from: a failure or interruption of the service; a false positive; a false negative — including an alert that did not fire and an incident that was not detected; any decision taken on the basis of the service's output, including its AI analysis; or any loss of data, revenue, profit, or reputation, whether direct, indirect, incidental, special or consequential.
Where liability cannot be excluded, it is limited in aggregate to the amount you paid for the service in the twelve months preceding the event giving rise to the claim. Where you paid nothing, that amount is zero.
Nothing here excludes liability that the applicable law does not permit to be excluded — including liability for fraud or for wilful misconduct.
You are responsible for the data you send to the service, for having a lawful basis to process it, and for configuring redaction to match your obligations. The product masks personal data it recognises, and the detectors it uses are documented on the security page; recognising a value is not the same as recognising every value.
You are responsible for keeping credentials secure, for the access you grant inside your workspace, and — on a self-hosted deployment — for the infrastructure the software runs on, its backups, and its encryption keys.
No uptime commitment or support response time applies at the self-serve tiers. Where a plan or a signed agreement states an SLA, that document governs.
We may change, suspend or discontinue parts of the service. Where a change materially reduces what a paid plan provides, we will give notice before it takes effect.
You retain ownership of your data. We process it to provide the service, under the retention window configured in your workspace, and delete it when that window passes or when you delete it.
On a self-hosted deployment, your data stays in your infrastructure and Solution4Mac receives none of it.
Paid plans are billed as described at the point of purchase. Where these terms change materially, the version below changes with them and acceptance is requested again; continuing to use the service after that point means accepting the new version.
These terms are governed by the laws of Brazil, and any dispute is subject to the courts of the district where Solution4Mac is established, unless the applicable consumer law grants you a different forum.
